These Terms of Use (“Terms”) govern your use of the Wend mobile application (“the App”) published by AppUp Labs (“we,” “our,” or “us”). By installing or using the App, you agree to these Terms. If you don’t agree, please don’t use the App.
The App is a single-player word-search puzzle. In Wend, you find hidden themed words by tracing through a letter grid in any of eight directions, including diagonals. The App offers a daily puzzle along with a growing library of levels of increasing difficulty, and it tracks your progress, streak, and rewards on your device. All gameplay runs on your device. There is no online multiplayer, no chat, and no real-time component.
You use the App without an account. There is no sign-in. Your progress is stored locally on your device, as described in the Privacy Policy.
You may use the App if you can form a binding contract with us under the laws of your jurisdiction. If you are a minor, you confirm that your parent or legal guardian has reviewed and accepted these Terms on your behalf.
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, solely for your own non-commercial enjoyment.

This licence terminates automatically if you breach these Terms. On termination, you must uninstall the App.
The App, its source code, design, artwork, copy, audio, brand, and all associated materials are owned by AppUp Labs and are protected by copyright, trademark, and other intellectual-property laws. Nothing in these Terms grants you any right, title, or interest in the App other than the limited licence in Section 3.
Puzzle layouts and word lists in the App are provided to you for personal play. You may capture and share screenshots of your own results for personal, non-commercial purposes.
The App does not host user-generated content. If you contact us by email, the content of your message is treated under the Privacy Policy. By sending us feedback, suggestions, or bug reports, you grant us a non-exclusive, royalty-free, perpetual licence to use that feedback to improve the App. We don’t owe you anything in return for unsolicited ideas.
The App’s handling of data is described in the Privacy Policy. In short: there are no accounts, your gameplay and progress are stored on your device, the only data that leaves your device is anonymous usage analytics and crash reports (neither tied to your identity), and there are no ads.
We may update, modify, or discontinue the App (or any feature of it) at any time. We may release new versions through the Apple App Store and Google Play Store on our own schedule. We are not obligated to provide updates, support, or maintenance for any specific version.
If a future version of the App changes meaningfully (for example, introduces a paid feature or new third-party integrations), we’ll update these Terms accordingly and surface the change in-app for material updates.
You acquired the App through a third-party platform (Apple App Store or Google Play Store). Your relationship with that platform is governed by its own terms; this document governs the relationship between you and AppUp Labs. The platform is a third-party beneficiary of these Terms to the extent of any applicable platform requirements.
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING (BUT NOT LIMITED TO) THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. PUZZLE DIFFICULTY, COMPLETION TIMES, AND REWARD CRITERIA MAY CHANGE BETWEEN VERSIONS.
To the extent any warranty cannot be disclaimed under applicable law, that warranty is limited to the minimum scope and duration permitted by that law.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL APPUP LABS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, BUT NOT LIMITED TO, LOST PROFITS, LOST DATA, LOST STREAKS, OR DEVICE DAMAGE) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total cumulative liability to you for all claims relating to the App is limited to the greater of (a) the amount you paid us for the App in the twelve months preceding the claim, or (b) ten U.S. dollars (USD $10).
Some jurisdictions don’t allow these limitations; in those jurisdictions our liability is limited to the smallest amount permitted by law.
You agree to indemnify and hold AppUp Labs harmless from any claim, demand, loss, or damages (including reasonable attorneys’ fees) made by any third party arising out of (a) your breach of these Terms, (b) your misuse of the App, or (c) your violation of any law or rights of a third party.
You may stop using the App at any time by uninstalling it. We may suspend or terminate your access to the App at any time, for any reason, including breach of these Terms.
On termination, Sections 4 (Intellectual Property), 5 (Your Content), 9 (Disclaimer), 10 (Limitation of Liability), 11 (Indemnity), and 14 (Governing Law and Disputes) survive.
We may revise these Terms from time to time. The “Last updated” date at the top of this document reflects the most recent revision. For material changes, we’ll surface a notice in the App. Your continued use after a change means you accept the updated Terms.
These Terms are governed by the laws of India, without regard to its conflict-of-laws principles. Any dispute arising under these Terms will be resolved by the courts located in India, except where mandatory consumer-protection laws of your jurisdiction require otherwise.
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and AppUp Labs regarding the App and supersede any prior agreements.
